This is the overriding area of law which can embrace any part of the contract of employment .As in the topic of Senior Executive Employment Contracts an inquiry will always start by a search for what are the terms and conditions of a contract. Also is the contract one of between an employer and employee or is it a partnership or independent contract providing services not one of service? Is the arrangement whereby work is to be performed work of a volunteer with no intention to create legal relations? Is the work covered by an A Modern Award, if so which one? If the employment contract is to be terminated how it is to be done lawfully or done in a way which falls foul of the unfair dismissal laws?
